Plaintiff purchased a home secured by a now $92,400.00 promissory note and deed of trust with Defendant New York Mutual, LLC on real property located at 1317 40th Street, Galveston, Texas 77550. The promissory note and/or deed of trust associated with the property allowed Plaintiff to pay his loan in full before the final maturity date on the loan. Plaintiff, on numerous occasions, requested pay-off quotes from Defendant so that he could pay his entire balance on the loan. However, to date, Plaintiff has not received a proper pay-off quote and Defendant is in the process of selling Plaintiff’s home during a November 7, 2017 foreclosure sale.
