Plaintiff, FIRST HORIZON HOME LOANS, a Division of FIRST TENNESSEE BANK NATIONAL ASSOCIATION, Successor by Merger to FIRST HORIZON HOME LOAN CORPORATION (hereinafter referred to as “Plaintiff’ or “FT MORTGAGE”), appeared and Defendants, ZEUS MORTGAGE, LTD., and STEVEN KAUFMAN, did not appear, but agreed to the entry of this Judgment by their signatures below. After reviewing the pleadings on file, and the arguments of counsel, the Court finds, as follows:

1. On the claim of Common Law Fraud, the court finds in favor of Plaintiff, FT MORTGAGE, and against Defendants, ZEUSMORTGAGE,LTD.,and STEVEN KAUFMAN, Jointly and Severally;

2. On the claim of Statutory Fraud, the court finds in favor of Plaintiff, FT MORTGAGE, and against Defendants, ZEUS MORTGAGE, LTD., and STEVEN KAUFMAN, Jointly and Severally;

3. On the claim of Breach of Contract, the court finds in favor of Plaintiff, FT MORTGAGE, and against Defendants, ZEUS MORTGAGE, LTD., and STEVEN KAUFMAN, Jointly and Severally;

4. On the claim of Conspiracy, the court finds in favor of Plaintiff, FT MORTGAGE, and against Defendant, Defendants, ZEUS MORTGAGE, LTD., and STEVEN KAUFMAN, Jointly and Severally;

5. The Court further finds that Plaintiff, FT MORTGAGE, is and is hereby, entitled to money judgment against Defendants, ZEUS MORTGAGE, LTD., and STEVEN KAUFMAN, Jointly and Severally in the amount of Three Hundred Thousand Dollars even ($300,000.00), which amount is inclusive of pre-judgment interest and costs.

6. Plaintiff, FT MORTGAGE, is entitled to postjudgment interest on the total amount of the judgment and any prejudgment interest awarded hereinabove, at the rate of 5% per annum from the date this judgment is signed until paid.
